Terms and Conditions
Last updated: 03/09/2026
1. Introduction
These Terms and Conditions govern your use of this website and any services provided by Wild Grass – Digital Services, operated as a sole proprietorship in South Africa. By using this website or engaging our services, you agree to these terms.
2. Services Offered
We provide website design and development, branding and design work, and website/lead-capture automation services (including AI chat and WhatsApp integrations). The specific scope, deliverables, and pricing for any project will be confirmed separately in writing (via quote, proposal, or invoice) before work begins.
3. No Guarantee of Business Outcomes
While we design websites and automation systems with the intention of helping capture and manage customer enquiries effectively, we do not guarantee specific business outcomes such as a particular number of leads, bookings, or sales. Results depend on many factors outside our control, including market conditions and how the tools are used day to day.
4. Hosting & Third-Party Reliability
Our websites are typically hosted via Afrihost, a paid hosting provider offering SSL encryption and standard security measures. We are not responsible for outages, data loss, or security incidents that occur at the hosting infrastructure level, as these fall under Afrihost’s own service terms and are outside our direct control. Similarly, third-party services integrated into your site or automation (e.g. WhatsApp Business API providers, Google Workspace) are governed by their own respective terms.
5. Limitation of Liability
To the fullest extent permitted by law, Wild Grass – Digital Services shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or our services, including but not limited to loss of business, loss of data, or loss of profit, except where such liability cannot be excluded under South African law.
6. Intellectual Property
Upon full payment for a project, ownership of the final website design and content created specifically for the client transfers to the client. Any underlying tools, templates, or frameworks used to build the site remain the property of their respective owners/licensors.
7. Payment Terms
Payment terms (deposits, milestones, final payment) will be specified in the individual quote or invoice provided for each project. Generally a 50% deposit is required before work begins, with the balance due on completion.
8. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
9. Changes to These Terms
We may update these Terms and Conditions from time to time. Continued use of this website after changes are posted constitutes acceptance of the revised terms.
